How to Become a Notary Public - New York State's Requirements

In New York State, notary publics assist individuals and businesses with the execution of important documents. They notarize contracts, wills, mortgages and leases and may serve as impartial witnesses to oaths or depositions. New York Notary Public License Law ensures that individuals who are commissioned as notaries meet certain standards and possess a thorough understanding of the office's duties and responsibilities.

  1. Requirements

    • To become a notary public in New York State, individuals must be at least 18 years old and a U.S. citizen. In addition, notary publics must either be a resident of New York or employed in the state. An individual with prior felony convictions in New York is not eligible to become a notary. Those who wish to become a notary must pass a written exam and submit an application to the Secretary of State. Attorneys in New York State may be appointed notary publics without passing an exam.

    Exam

    • The New York Notary Exam is a multiple choice test, which candidates have one hour to complete. The exam is given at authorized notary test centers throughout the state on a walk-in basis and requires a fee to take. Within a few weeks of sitting for the exam, individuals receive a pass or fail notice. Individuals must submit their application to become a notary within two years of the date they take the exam, or the results are no longer valid. In addition, they must take the Oath of Office before an established notary and submit all necessary paperwork to the New York State Department of State before their commission as a notary becomes official.

    Duties

    • In New York, a notary public is licensed to administer oaths and affirmations and take affidavits and depositions. They are also permitted to certify deeds, mortgages, powers of attorney and financial documents. In addition, New York notary publics may make formal demands for acceptance or payment of foreign and inland bills of exchange, promissory notes and obligations in writing. They may protest nonacceptance or nonpayment as well. Under the New York State Notary Public License Law, notaries are allowed to charge $2 for each action they perform.

    Restrictions

    • New York notary publics are not permitted to act as legal representation during court proceedings if they are not licensed as attorneys. They may not prepare legal documents, such as deeds, mortgages, leases or wills, either. If a notary violates any of these sections of New York Notary License Law, they may be charged with a misdemeanor and removed from office. Notaries may also face punishment if they falsely certify documents or certify a document they know contains false information or statements.

    Renewal

    • Under New York Notary Law, a notary's license is valid for four years. The State Department sends a renewal application shortly before the notary's expiration date, and it must be returned, along with a fee, to the county clerk.

Eligibility
